what happened to my NST fraud alert thread?

everything i stated there is factual, mike sent me a used pulley in place of a new one.


update: mike has contacted me and we are working things out, i hope.

edit / update: nonstoptuning and I appear to be working this situation out. I'm hoping for a positive resolution. As I've said in the past, I like their products and have had good service before. Hopefully this is an isolated incident that is just a misunderstanding or easily corrected mistake.

so, here's the timeline of nonstoptuning ripping me off

Thu, Dec 20, 2012 at 3:39 AM I placed the order online for the 1grfe crank pulley.

12-20-2012, 03:41 AM i posted on XRU that i was aware of the inventory problem.

dec 20 12:46pm i called and got your vm

dec 20 4:20pm i left you a voicemail on your shop's number 281-917-0221

Thu, Dec 20, 2012 at 4:24 PM - email from me, i inquired as to what the status was

dec 20 5:35pm i called and got your vm, did not leave a message.

dec 20 6:55pm i called and got your vm, did not leave a message.

Mon, Dec 24, 2012 at 6:29 PM - email from me, i responded asking for a discount since it was used and wanted to set up a future group buy.

Fri, Dec 28, 2012 at 12:10 PM - email from me, asking for an update/answer to my 12/24 email.

Tuesday, Jan 1, 2013 at 11:25 - this email, from me, asking for a response or a refund.

Wednesday, Jan 2, 2013 - true to my word in the 1/1/13 email, I dispute the charges with my CC company.

Saturday, Jan 5, 2013 - a USED red pulley shows up at my door. No word from nonstoptuning since monday, 12/24/12.

sometime on saturday, jan 5, 2013 - my complaint thread in nonstoptuning's subforum was deleted.

I never agreed to a used pulley and nonstoptuning have not contacted me to negotiate a price on the pulley given its used condition. I will be contacting my CC company to update them with the situation and will likely be mailing the pulley back to nonstoptuning after documenting its condition.

By that listing on his website, it is for a new pulley since it doesn't mention otherwise.

yes. you'll also see that my response to his email states that "Yes, I am still very much interested in the pulley, though I expect a discount given the used condition of the product you're offering. "

so yeah, i never agreed to that pulley at that price.

you'll also see the invoice in the back of the photos showing what i was charged.


he's a fraud, plain and simple.

site still has it listed at 108, mike hasn't said anything to me about price. nothing. not a word. the XRU thread only indicated that the 12/15 deadline has to do with the gas card.

even with that statement on the site, i was sent a used pulley with no negotiation or warning on the price, and was charged the same price as other people who purchased a new pulley.


btw gadget, no shirt, no gas card. lol.

i expect my money back. i was sent a used pulley when i purchased a new one.

that's fraudulent.

I have a feeling you will be getting your money back, but it takes a bit. I would wait and see what happens from this point.

i'm pretty sure that the gouges and anodizing wear on the item make it damaged, so either it's goods received as damaged or goods received in condition other than specified, and/or i never authorized in writing or verbally the substitution of goods as i ordered a grey, new pulley and received a used red pulley.


the truth is that i just want mike to own up to his lack of communication and negotiate a fair price with me, or refund my money and i'll send the pulley back on my own dime. i'm not trying to rip anyone off, i just want to be treated fairly.

at this point the ball's in his court, he can get this resolved a lot faster than dragging it out with my CC company if he is willing to man up and admit that he dropped the ball and email me to negotiate the price of this used pulley that i did not order in writing.

trust i understand your frustration, but since the charges have been disputed it wont be that simple. Now the banks and credit card company are involved and they all have to communicate with each other and the merchant in order to resolve it.

By mike sending you the pulley it doesnt automatically cancel the disputed charge. He will either agree or disagree with what you said on the dispute and then it goes from there.
